Peda.net common license: licencing accordingly with terms of use

Terms of use do not have affect to materials' ownership: the ownership remains with the legal owner. Service provider does not receive any additional rights to users' material except what must be maintained in order to run the service as the terms of use define.

Basically this means same as "all rights are reserved" with the exception that Peda.net reserves the right to share the original copy and its derivatives (e.g. icons created from the image) according to user's defined publicity settings, and to back-up the content.

It is not possible to save any copyright material to Peda.net service without agreeing the terms of use. Thus, all the saved material is licensed at the very least according to terms of use.

PEDA.NET SERVICE'S TERMS OF USE

1. SERVICE CONTENT AND TERMS OF USE

Peda.net (later referred as service provider) is an online service maintained by the University of Jyväskylä. It works in a browser. The service is especially targeted for educational institutions and individuals (teachers, students) in those institutions, but it may be used by organizations, enterprises and private persons. Peda.net service includes e.g. personal profile space (PPS), educational institutions' online learning environments and educational institutions home pages. These terms of use are applied to the use of the service (later referred as service) mentioned above. Terms of use regulate the relationship between the service provider's and service users (later referred as user or users). All the rights are owned by the service provider and the user is granted right to use the service according to these terms and conditions. By signing up for the service user agrees the terms of use and pledges to act accordingly. If the user disagrees the terms of use, he/she cannot use the service. In addition, user is must abide by Finnish law, all the applicable statutes and good manners.

2. PRIVACY POLICY

Service provider follows Finnish law when processing personal data. For more information, please see the register policy. It is strongly recommended to read the register policy when creating an account to Peda.net service.

3. SIGNING UP AND CREATING A USERNAME

Every Peda.net user may possess only one account. When creating an account to Peda.net service, all the asked personal identifying information should be provided to Peda.net. User is granted a username and a password, that are used to signing in to service. A username connected with the account must not include offending phrases nor suggest criminal action, and it should follow good manners.

Anyone over 15 years can create an account and sing up for the service at will.

Individual under 15 years must have guardian's permission to use the service. For acceptable permission, individuals under 15 years must provide Peda.net service with guardian's e-mail address. Service provider will then send Terms of Use and sufficient registration information to the given e-mail address. The guardian must read and accept the terms of use together with the individual under 15 years. The guardian will reserve the right to restrain the individual under 15 years from using the Peda.net service, which can be done notifying the service provider. In case of restraining the account of person under 15 years, guardian must be able to provide legal proof of the custody.

The user must provide all the asked information correctly and thruthfully. Service provider may act according to these terms of use to freeze or terminate the account, if the account holder has attempted to mislead the service provider with false information or providing e.g. wrong guardian's e-mail address.

All the users will be held responsible for the content and actions performed with their account. Username and password are for personal use, and they are not to be disclosed to any third party. If the user suspects that his/her account log in information has leaked, service provider must be informed at once.

4. DATA STORAGE AND BACK UP

Service user can save material to service provider's servers. However, service provider won't quarentee persistance of the saved material nor the possible damage caused by material destruction, disappearance, termination or alteration. In order to guarantee the information persistance, user is responsible for creating sufficient back-up files of materials saved to service provider's server.

5. REFRAINING FROM CERTAIN ACTIVITIES

Service user is held responsible for all the material he/she saves to the service and/or provides to others by using the service (this concerns uploaded material, linked content and all the other ways to share material). Service provider does not moderate users created material and thus is not to be held responsible for the contents in the service. Service must not be used to share or save material that:
  • Offends third parties copyrights or any other rights
  • Offends, disturbs or threathens someone
  • Causes malfunction for the service
  • Is against the law or good manners
The service must not be used for commercial activities.

Every service user is responsible to notify service provider immediately, if he/she encounters material or other activities that violates service's terms of use.

6. RIGHTS TO USER CREATED CONTENTS

An example of the situation described above could be following: an image uploaded to service is shared between the other users according to publicity settings. Different versions of the image may be shared through third parties proxy servers in order to enhance the performance.

In addition, service provider is entitled to act by rights, as mentioned in section 10 (Consequences of acting against terms of use).

7. MODIFICATIONS TO THESE TERMS OF USE

Service provider reserves right to modify the terms of use at any given moment without users' agreement. In case of editing the terms of use, users will be notified. In case of renewing the terms of use, using the service after receiving the notification of edits will be considered agreement of new terms of use.

8. SERVICE MAINTENANCE AND UPDATES

Service provider attempts to provide as reliable service as possible. However, service provider does not guarantee that service functions nor that all the features function.

Service provider attempts to develope the service continuosly. This is why modifications to the service can be made. Service user understands and accepts that decisions concerning service development, modification and partial or complete service termination are solely under service provider's right of decision.

9. SERVICE MAINTENANCE BREAKS

Service provider is not responsible for the damage caused by malfunctions, maintenances, updates, data connections or any other service breaks.

10. CONSEQUENCES OF ACTING AGAINST TERMS OF USE

Service provider is entitled to delete material saved or shared via service, if it violates service's rules or principles mentioned in terms of use.

In addition, service provider may freeze or terminate user's account, if the user violates terms of use (by e.g. adding material that is against terms of use or using the service against good manners).

Once the service provider learns about acts violating terms of use, service provider may freeze or terminate an account at once. In that case, user cannot log in to his/her account and the personal profile space is hidden from the other users. If the user attempts to log in, he/she receives a notification stating that the account is locked and is provided with the contact information for further account. If the user contacts the service provider during the 90 days time period after account freeze, service provider and the user can agree the consequences and possible service usage, if the violation is not severe. If the user does not contact the service provider during the 90 days period, user's account may be permanently terminated.

11. ACCOUNT TERMINATION IN OTHER CASES THAN ACTING AGAINST TERMS OF USE

In addition to what is mentioned in section 10, Peda.net reserves the right to suspend or end a user account if the following conditions are met:
  • User has not logged in to his/her account for over 12 months and
  • he/she has been notified of the account termination in case of continuing inactivity and
  • user has been asked to answer the notification but he/she does not respond during the 90 days time period starting from the notification day.
If service provider is not contacted during 180 days after account freeze, a user account can be permanently terminated.

12. DISPUTES AND JURISDICATION

Finland's law is applied to these terms and conditions. All the disagreements are attempted to resolute through resolution procedures. In case of a filing legal claim against Peda.net, claimer agrees to file and resolve legal claim in Middle Finland District Court (Keski-Suomen käräjäoikeus).
